What these terms and conditions are about. These are the terms and conditions of sale (hereinafter: “GTCS”) under which we, Skechers S.à.r.l., offer, sell and deliver our products to you via the www.skechers.ch website (hereinafter: the “Site”). 

 

Why should you read these GTCS? Please read these GTCS carefully before placing your order. These GTCS tell you who we are, how we offer, sell and deliver our products to you, what to do if you have a problem and other important information.

How can you contact us? The best way to contact our customer services team is to send an email to info.ch@skechers.com or call 0800 00 13 00 (Monday to Friday, 9am to 12pm and 1pm to 4.30pm).

 

How can we contact you? If we need to contact you, we will call or write to you at the email or postal address you provided when you placed your order. 

 

Our contract with you

 

How do we accept your order? Your order constitutes an offer to purchase all the products it contains. We must accept your order. If we do not accept your order, no contract is formed. We may, at our sole discretion, decide not to accept your order. Your order is deemed to be accepted when we send you a confirmation email. On receipt of this email, a contract of sale is concluded. 

 

What if we are unable to accept your order? If we are unable to accept your order, we will inform you in writing and will not charge you for the product. The reasons why we may not be able to accept your order are, for example, that the product is no longer available, your billing details are incorrect or cannot be verified, we have discovered an error in the price or description of the product or we cannot meet the delivery deadline you have chosen.

 

Your order number. When we accept your order, we assign it an order number. We will give you this number in our confirmation email. If you contact us about your order, please include your order number.

 

The products are not authorised for resale or export. You represent and warrant that you are purchasing products from the Site solely for your personal or private use and not for resale or export. 

  

Prices and payment

 

Where can I find the product price? The sale price is the price of the product, all taxes included, indicated on the Site when the order is placed. All prices, discounts and promotions published on the Site are subject to change at any time without notice. 

 

What happens if we display the wrong price? We check prices before accepting your order. If the correct price of the product at the time of your order is lower than the price we have quoted on the Site, we will charge you the lower amount. If the correct price of the product at the time of your order is higher than the price we have indicated on the Site, we will inform you and ask for your instructions before accepting your order. In the event of a material pricing error, the party intending to invoke the error may rescind the contract. In this case, we will refund all sums paid to us and you must return all products delivered to you.

 

When and how do you pay? Payment must be made before products are dispatched. We accept payment by MasterCard, Visa, and American Express. You represent and warrant that (I) the credit card information you provide to us is true, accurate and complete, (II) you are duly authorized to use that credit card for the purchase, (III) the charges you incur are approved by your credit card issuer, and (IV) you agree to pay all charges incidental to the sale price, in particular delivery and processing charges.


Product delivery

 

Place of delivery. Delivery is only made within Switzerland.

 

Delivery charges. Delivery charges are indicated on the Site. The sale price does not include delivery and processing charges. All these charges are added to the amount of your order and are indicated in your basket and in your order confirmation email. 

 

When do we deliver the products? During the ordering process, we inform you of the date on which your products will be delivered.

 

We are not responsible for delays due to events beyond our control. If the delivery of products is delayed due to events beyond our control, we will contact you as soon as possible and will try, as far as possible, to minimise the impact of the delay. We accept no responsibility for delays due to events beyond our control, although we will take steps to try to minimise the impact. However, if there is a risk that the delay will continue, you may contact us to cancel the contract and obtain a refund of the price of the products you have not yet received. 

 

What happens if you don't receive our products? If you are not at home to receive our products and they do not fit in your mailbox, we will leave you a message telling you how to arrange a new delivery or collect the products from a deposit point near you. If, after a missed delivery, you fail to arrange a new delivery or collect the products from the designated deposit point, we have the right to terminate the contract.

 

Your rights in the event of late delivery. If we are late in delivering products to you, your rights are those set out in the Swiss Code of Obligations. In particular, you may rescind the contract and claim damages if, alternatively:

 

  1. we refused to deliver the products;
  2. delivery within the delivery period was essential (taking into account all the relevant circumstances) or
  3. you had informed us, prior to acceptance of your order, that timely delivery was essential.

 

 

Transfer of risk and ownership of products

 

When do you assume responsibility for the products? You are responsible for the products from the moment we deliver them to the address you have indicated.

 

When do you become the owner of the products? You become the owner of the products when we deliver them to the address you have indicated.   

 

Returns

 

Right of return for purchases made on the Site. For all purchases made via the Site, we grant our customers a right of return for a total of 45 days from delivery of the products. You can return unworn products in perfect condition within 45 days of delivery and obtain a refund by following the instructions below. 

 

Your right of withdrawal is not affected by this right of return and remains valid irrespective of it. This means that, as a customer, you can withdraw from the purchase up to the expiry of the withdrawal period under the conditions set out therein - without complying with the provisions of this right of return.

 

The right of return granted herein does not limit your statutory warranty rights either.

 

How do I request a refund? To return an order and get a refund, download the returns form either by logging into your Skechers account at www.skechers.ch “MY ORDER” or by clicking on the link to your order status that you received in our order confirmation email, then complete the form. Once you have completed the form, please return it to the address indicated in the form. For more information, please see our Returns Policy. 

 

Please use the shipping label to return the order. Please also make sure that you do not remove the labels on the products and that you return the shoes intact in their original box.

 

It is not possible to return products ordered on the Site to Skechers shops.

 

Coverage of return delivery costs. We cover the cost of return delivery.   

 

Here's how we refund you. If you follow the instructions above, we will refund the price you paid for the products. The refund will be made according to the method of payment you used. However, as indicated below, in some cases we will deduct a certain amount from the price.

 

Deductions from refunds. If you exercise your right of withdrawal or return, we may deduct from the refund (excluding delivery costs) an amount corresponding to the depreciation of the products if their loss of value is due to your handling which was not necessary in order to verify their nature, characteristics and operation. If we refund you the price you paid before analysing the products and subsequently find that they have been damaged as a result of unnecessary and improper handling on your part, you must refund us the amount corresponding to the loss in value of the products.

 

How will I be refunded? We will refund you within 14 days of the date on which we receive the products you have returned. Once the products have been returned and payment made, the contract ends.

 

Warranty. Skechers S.à r.l. is liable for defects in the products delivered in accordance with the legal provisions applicable in Switzerland. The liability of Skechers S.à r.l., and therefore the warranty for defects, shall lapse if the product is damaged as a result of improper handling and/or use by the customer. 

 

To report a defect, please fill in the form that you will find in your account www.skechers.ch "MY ORDER" or via the link to your order status on the home page of www.skechers.ch and send it to the address indicated on the form.

 

Our rights to terminate the contract

 

We may terminate the contract if you fail to comply with these GTCS. We may also terminate the contract at any time, in writing, in the following cases:

 

  1. You do not pay for the products within the time limit set and you still have not paid for them 14 days after we have reminded you;
  2. You do not allow us to deliver the products within a reasonable time.

  

Liability for loss or damage

 

We shall not be liable to you or to any third party for any loss or damage of any kind, whether or not such loss or damage was foreseeable, whether or not we were advised of the possibility of such loss or damage, or the legal basis on which such loss or damage arises.   

 

The aforementioned limitation of liability applies within the limits of compliance with the mandatory provisions of Swiss law. It does not apply to liability resulting from gross negligence or wilful misconduct on our part, or to injury to life or limb resulting from our acts or omissions.

 

Our maximum, sole and total liability, however caused, and your sole and exclusive remedy, however caused, is limited to the amount you paid for the you ordered from the Site.

 

Force Majeure. We shall not be liable to you and shall not be deemed to be in breach of our obligations or in breach of these GTCS if and to the extent that any failure or delay is caused by an event of force majeure, including, without limitation, flood, fire, earthquake, explosion, governmental action, war, invasion or hostilities (whether war be declared or not), terrorist threats or acts, riots or other civil disturbances, national emergency, revolution, insurrection, epidemic, pandemic, lock-out, strike or other industrial dispute (whether or not affecting our personnel) or restrictions or delays affecting transport undertakings, inability or delay in obtaining adequate or suitable materials, breakdown of materials or telecommunications or power failure.

 

No waiver. Our failure to enforce any right or provision of these GTCS shall not constitute a waiver of such right or provision in the future. A waiver of any right or provision of these GTCS will be effective only if in writing and signed by a duly authorized representative of Skechers S.à.r.l..

 

No third party beneficiaries. These GTCS are not intended to confer any rights or obligations on any person other than you.

 

Assignment. You will not assign any of your rights or delegate any of your obligations under these GTCS without our prior written consent. Any assignment or delegation made in breach of this clause will be null and void. No assignment or delegation will relieve you of your obligations under these GTCS.

 

Severability. If any provision of these GTCS is invalid, illegal, void or unenforceable, that provision shall be deemed severable from these GTCS and shall not affect the validity or enforceability of any remaining provisions.

 

Entire agreement. The order confirmation, these GTCS, the Terms of Use and our Privacy Policy form an integral part of the contract of sale.

 

Alternative dispute resolution. Alternative dispute resolution is a process whereby an independent body examines the facts of a dispute and attempts to resolve it amicably. We are not obliged to use an ADR scheme and do not currently participate in one.

  

Other important conditions

 

Applicable law and place of jurisdiction. These GTCS are governed by Swiss law, to the exclusion of the rules of private international law. Any legal action relating to our products may be brought before Swiss courts.
